Terms of Policy and Contract.
Special Offer* Definition
A Special Offer* is a product or service that is offered at reduced/discounted prices/rates by Anné Phillips Photography.
Special Offer* may not be available on a continuous basis. Special Offers* can end at any time and may end earlier then the promotion end date due to any number of reasons including, but not limited to, limited available photo session times or quantities of inventory (photo albums or photo frames)
Session Fees
Client agrees to pay photographer full amount of your selected Special Offer* package fee at the time of booking to secure their appointment date and time. Special Offer* package fees are a non-refundable retainer fee that goes toward your session. The amount covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and additional images/prints according to a package selected by you. Additional editing is available at additional expense to be determined by photographer. Additional prints or digital images may be available for purchase. All sessions include a consultation through email or on the phone.
Location Costs / Travel Fee
If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Small travel fee may apply which is determined during a consultation time prior booking.
Rescheduling
Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. Client is required to give the photographer 48 hours notice in writing via e-mail if client cannot attend their session time spot. Client may reschedule and use their fee towards a full session or wait until the photographer schedules another day of special offer (discounted) sessions. If the client fails to give 48 hours notice, then client forfeits the full fee without an option to reschedule.
Re-shoot / Refunds
Re-shoots are determined at the discretion of the photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair or weather related issues, or by lack of cooperation or not following the recommendations of the photographer. The Special Offer* fee is non-refundable (please see Rescheduling). Additional print fees are not refundable once images have been downloaded, print proof has been approved and prints ordered.
Archive of Session Images
After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
Damage
Photographer is not responsible for the damage of portraits or discs after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.
Model Release
I hereby give to Anné Phillips Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:
a) To copyright the same in the photographer’s name or any other name that he/she may select;
b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade. I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
Liability
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
Copyright and Penalty
Anné Phillips Photography retains all copyrights to all images created during client’s session. A print release is included with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Bonnie Iris Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file. Digital images and prints purchased from photographers can only be used for personal use and not for commercial, political, or any for-profit uses. A separate commercial release can be purchased if the images need to be used for anything other than personal use. Sharing on personal social media pages, web pages, or blogs is allowable but credit and link back to www.aphillipsphotography.com is preferred.
Once the full payment of a Special Offer* has been received you have agreed with the terms of this specials session policy and portrait contract with Anné Phillips Photography.
